(It is a Missouri Nonprobate Transfer)

Probate Answer – Get A Beneficiary Deed

I have no idea how many out-of-state timeshare owners own timeshare vacation properties in the State of Missouri. I am willing to bet that over the years hundreds of thousands of  people purchased vacation properties within the State. My wife and I live in Minnesota and we own one of our timeshare properties at Lake of the Ozarks called  Tree Top Village and we love it. We have only stayed at the resort once in the 10 years since our purchase. We will be going back in 2012 to stay for our summer vacation week.
One of the main concerns over the years as we aged a bit was how we would transfer ownership of our unit to our children. On one of our visits to the county where our resort is located we stopped at the courthouse to talk to the county officials about how to go about transferring ownership since we were out-of-state owners and in Minnesota the vacation week we own would have to go through probate. We did not want that.

Well, Missouri has solved the probate answer problem for out-of-state timeshare owners. Here it is. It is called a Beneficiary Deed, in other words, (Missouri Nonprobate Transfers). It means exactly what it says. This Missouri Form R11D-2 allows anybody to complete the form, have it motorized as to who the beneficiaries would be, file it,  and upon the death of one or both owners the Beneficiary Deed takes affect with the courthouse in the county where the timeshare property is located, without going through any probate outside the state of Missouri. So the probate answer in Missouri is to get a Beneficiary Deed from a office supply store or to copy the beneficiary forms below. This should put a lot of timeshare owners who own in Missouri but live in other states, at ease. So, that’s your probate answer folks!  Has this helped? Leave a comment either way. Thanks.
